Sujit Choudhry – Mueller’s Firing Would be a Democratic Failure

Sujit Choudhry is a well respected expert in constitutional law. He has assisted countries from all over the world in establishing a democratic constitution and now teaches law at Berkeley. Sujit was recently given an entire chapter in a recent book to describe his thoughts on former Attorney General, Eric Holder and a tweet Holder published in December of 2017

“If removed or meaningfully tampered with, there must be mass, popular, peaceful support of both,” Holder wrote on Twitter. Holder was referring to Robert Mueller and his special investigation.

Mueller is leading the investigate into Russian interference in the 2016 election. People have been speculating since Mueller was appointed as to whether Donald Trump would make an attempt to fire him.

Holder’s tweet is simply stating that should Donald Trump fire the special investigation, citizens, not the government will be the ones to decide whether it is okay or not.

In the chapter, Sujit Choudhry  goes into great detail explaining what he believes Holder really meant by the tweet. Sujit says that there are two possible meaning of Holder’s tweet: he is either being literal or figurative. Either Holder believes that citizens will protest upon the firing of Robert Mueller or he is simply stating that the firing of Robert Mueller is a boundary that should never be crossed. Sujit says that the firing of Robert Mueller would be no different than a US President attempting to extend term limits. The firing would go down in history as a democratic failure.


One thing that Holder didn’t mention in the tweet was criminal repercussions. According to Holder, civil unrest is probably the only repercussion of a Mueller firing. “It is striking that Holder, once the nation’s chief law enforcement official, does not even mention a legal challenge to attempts to obliterate Mueller’s authority,” Sujit writes.  Additional article on

As the director of the Center for Constitutional Transitions and a Professor in the field of law, Sujit Choudhry was obliged to respond to Eric Holder’s tweet. As per Choudhry’s point of view, the call for peaceful protests should anything happen to White House Special Counsel Robert Mueller symbolized a “red line” concerning the boundaries set within the American constitution ( As per the other point of view, the American people would be the judges of whether the various officials have crossed the multiple boundaries regarding the powers that have been bestowed upon them by the American constitution.

Choudhry indicates that Holder mentions that the American people are the final say on how the issue will be addressed. The American people will determine whether the symbolic “red line” will be upheld or not. He also indicates that the tweet by Eric Holder has been based on “constitutional self-enforcement based on the concept of a focal point.” The constitution governs both the citizens and also the authorities within a nation. As per Choudhry, he expresses utmost surprise that Eric Holder who was once a law enforcement official, couldn’t have sought legal means to challenge the termination of Mueller as the White House Special Counsel.
